I have the honour to transmit the enclosed

Memorandum explanatory of the very lengthy proceedings, which have occupied the Courts here during the past few months, arising out of an application by the Chinese Government for the extradition of one Chung Sau-nam (the transliteration of the man's name pronounced in the Cantonese dialect). Sir Francis Piggott, formerly Chief Justice of Hongkong, has appeared for the fugitive throughout these proceedings. The Crown was assisted by Solicitors and Barristers in private practice by special permission at the request

of the Chinese Government.

The Police Magistrate committed the fugitive

for extradition. Proceedings in Habeas Corpus were thereupon instituted with the result that the lagistrate's finding was up- -held. Whereupon an application was made by the fugitive for leave to appeal to the Privy Council. This application was refused and it is now understood that application will be made on behalf of the

fugitive to the Privy Council for such leave.

3.

I have decided that I shall not permit the

Chinese Government to engage Solicitors and Counsel to assist the

Crown in any further proceedings that may be taken in this case, for the reasons explained in my Despatch Confidential of even date.

In the circumstances the Hongkong Government assumes the sole

responsibility
